Agreement
These Terms of Use ("Terms") are a binding agreement between you and Amitay (individual, based in the Netherlands), trading as Estelle and thebits.club ("we", "us", or "our"). By accessing or using Estelle ("the Service"), you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
Who we are

Eligibility
You must be at least 18 years old to use Estelle. You may use the Service only for your personal performer booking activities, not on behalf of a third party unless you have authority to bind them.
Description of the service
Estelle is an AI-assisted booking workflow that helps performers find gig opportunities and manage outreach over email. The Service may scan venues and events, send you shortlists, and contact bookers only for venues you approve.
Beta access
Estelle is in beta. We onboard users in waves and may change, suspend, or discontinue features at any time. Beta access is currently free. We may limit or revoke access to protect the service or other users.
Account registration
You agree to provide accurate profile information and keep your account secure. One account per person. If you use Google sign-in, Google's terms also apply to that authentication.
Your authorization
You authorize Estelle to:
- Send booking-related emails to you (shortlists, confirmations, status updates, and account messages)
- Contact venues and organizers you select, using your profile information to request booking opportunities
- Use AI to search, classify, and draft booking-related content subject to your approvals and settings
AI terms
- AI-generated content may contain errors. Review it before relying on it or sending it to third parties.
- You remain responsible for your communications, performances, and any agreements with venues or organizers.
- AI models and providers may change over time as we improve the Service.
Acceptable use
You agree not to misuse the Service, including by sending spam or harassment, misrepresenting your identity or credentials, impersonating others, violating venue rules, attempting to bypass security or rate limits, or using Estelle for unlawful purposes.
Your content
You retain ownership of content you submit (profile text, notes, links, and similar materials). You grant us a limited license to use that content to operate the Service, including sharing it with venues you approve for booking outreach.
Third-party venues
Estelle is not affiliated with venues or organizers listed in the Service. Their rules and terms apply separately. We do not guarantee that any venue will respond, offer a slot, or book you.
No guarantee of bookings
We do not guarantee gig offers, acceptances, income, or any particular outcome. Estelle facilitates workflow and outreach; booking decisions rest with venues and organizers.
Intellectual property
Estelle's branding, website, and underlying materials are owned by Amitay/thebits.club. You may not copy, modify, or redistribute our materials without permission. Feedback you provide may be used to improve the Service without obligation to you.
Pricing and payment (after beta)
During beta, the Service is free. When paid plans launch:
- Prices will be shown clearly before purchase, including applicable VAT where required
- Where Dutch consumer law applies, you may have a 14-day right of withdrawal for distance contracts unless you expressly request immediate access to digital services during that period
- Subscriptions will be cancellable with no more than one month's notice; we will not silently renew you into a new fixed term without clear consent
- Refund rules will be stated at launch
Suspension and termination
We may suspend or terminate access if you violate these Terms or if needed for security or operations. You may stop using the Service at any time and delete your account in Settings.
Disclaimers
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by Dutch law, we are not liable for indirect or consequential damages, including missed gigs, venue disputes, reputational harm, or lost income. Our total liability for direct damages arising from the Service is limited to the fees you paid us in the 12 months before the claim, or €100 during free beta, whichever is greater. Nothing in these Terms limits liability that cannot be excluded under mandatory law (including for death or personal injury caused by negligence or intentional misconduct).
Indemnity
You agree to indemnify and hold us harmless from claims arising from your misuse of the Service, unlawful outreach, inaccurate profile information you provided, or violation of third-party rights, except to the extent caused by our intentional misconduct.
Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms on this page with an updated date and, where appropriate, notify you by email before material changes take effect. If you continue using the Service after the notice period, you accept the updated Terms. Where mandatory consumer law requires affirmative acceptance, we will obtain it.
Governing law and disputes
These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the courts of competent jurisdiction in the Netherlands, without prejudice to mandatory consumer protections in your country of residence. EU consumers may also use the EU Online Dispute Resolution platform.
